Location: Conway, AR                       Population Served: Non-Arkansas residents ages 6-21. Deaf and hard of hearing unit.

Aggravated Assault

Officer arrived at facility and saw three staff members holding resident down on the pavement of the parking lot; officer informed that resident had stabbed a staff member with a pen; resident started spitting on officers and staff; face mask applied; juvenile detention will not take resident, suggested resident be returned to her home state; while being taken into facility resident pulled fire alarm and spat on officers; officer contacted DHS to get information on  which section is responsible for facility oversight, no response.

Staff reported a resident had pulled a chunk of the staff members hair out and scratched her; staff wants to press charges on resident; officer took photos of scratches and added to report file.

    • 907.2 – self report today, staff on phone, resident in shower 45 minutes
    • 907.2, 907.3 – incident on 10/13/20 fight b/w peers, lack of supervision, out of ratio 1:13
    • 907.2, 907.3 – incident received on 10/26/20 lack of sup., out of ratio 1:7.
    • Supervision training for all staff required by 11/30/20.

    • 911.6 – graffiti on older girl’s unit wall, no date corrected listed
    • TA – fence leading to AC loose, “not completely secure as resident climbed it.”

    • 907.2 – Charles Arnold and Ebony Russ – followed up on incident report received 10/21 concerning a resident and staff. video footage reviewed, true licensing finding (907.2), staff on admin leave.
  • Corrective Action Required: staff shall be trained on consistently following the written discipline policy. Compliance date 11/30.
  • Licensing Complaint Determination notice. Complaint received on 10/13, video reviewed on 10/28, Ratio of 2-13 and lack of supervision was seen on video.
  • Licensing Compliant Determination Notice. Complaint received 10/28, video of incident reviewed and founded. Staff on phone and not paying attention to clients. Client in shower for approx. 40 to 45 minutes.
  • Licensing Complaint Notice. In response to report received on 10/28 following Corrective Action is required: Mr. Wilson stated that staff would be fired. See monitor visit on 10-28-20 for corrective action required.

Staff reported that resident had hit her in the face and spit on other staff; officers noted visible bruising to staff face; resident stated she would do other things to be taken to jail; officer contacted Juvenile Detention and was informed resident could not be taken there.

Facility reporting staff attacking resident; video shows resident and staff sitting at table when staff took papers from resident; resident approached staff and punched her, staff then took resident to the ground and “mounted” her, then began punching resident; staff was removed by other staff members; officer requested to speak to resident but was refused until facility can contact state in which resident resides.

Staff reported that a resident had been threatening to hit, slap, stab and kill staff members; staff stated resident is more aggressive everyday.

Staff reporting resident ran away and was heading toward highway; officer found resident, resident was compliant and willingly got into patrol car to be transported back to facility; resident stated she had a key to facility and could just walk out of facility

Staff reported that a resident requested the light be turned off; when staff turned lights off resident hit staff in the face, back, and arms; no injuries visible at time; staff stated they wanted to press charges on resident.

Resident called 911 and reported feeling suicidal; officers arrived at facility and staff stated they did not know resident had called; officer spoke with resident and resident stated they wanted to harm self; staff stated resident would be taken care of by “in house doctors”.

Resident called 911 to report that a peer attacked him in the shower, now his legs and stomach were hurting; MEMS arrived on scene and cleared resident; resident became upset and started stating he would kill himself; MEMS transported resident to Conway Regional Medical Center; staff stated he did not receive any reports of an altercation between residents.

Staff reporting five residents “jumped” him when he asked them to stop “rough housing”; staff stated residents kicked and punched his stomach area, refused medical.

Staff reporting that he was attacked by two residents; residents started flipping tables and when staff radioed for assistance residents tried to take the radio from staff, residents placed staff in choke hold and were hitting staff member; staff stated assistance arrived shortly after altercation began.
