Location: Conway, AR                       Population Served: Non-Arkansas residents ages 6-21. Deaf and hard of hearing unit.

Maltreatment, Notice of Incident

  • Maltreatment
    • Staff member reported to Risk Management that upon entering client’s room on 3/6/22, he saw another staff member shove client towards the bed. Client reported to Risk Management that the staff member shoved her to the bed, but stated it was a different staff member.
    • Child Abuse Hotline was called, not accepted. Risk Management received witness statements and reviewed camera footage of the incident. The incident was outside of camera view (client’s room). There were no injuries or bruises to either party involved. Both staff were placed on administrative leave until completing Handle with Care training. Specialist followed up on 3/18/22: Both staff accused are still employed at facility and have been retrained on the physical portion of Handle With Care, completion 3/9/22.

  • Maltreatment
    • Client reported to staff that a peer had been inappropriately touching her butt and making inappropriate comments during bible study. Client stated on 2/26, the peer had sat in her lap (staff did not see this due to dealing with another situation). Client asked the peer to get off her, and the peer complied. Client stated there had been no sexual activity between the two, and she is keeping her distance.
    • Child Abuse Hotline was called, screened out. Staff were notified to keep the two clients on separate ends of the unit and to monitor interactions. Both clients have spoken with their therapist to process the interaction and expectation moving forward. Client has agreed to inform staff of any interaction between her and peer if she feels interaction is crossing boundaries. The recreational therapist has been notified of the behaviors in bible study and will continue to keep the two separated. Specialist visited facility on 3/1/22: It was indicated the facility did not have the Child Abuse Hotline # at this time but would get it to licensing in the near future. Staff ratios reported to be within licensing standards.

  • Maltreatment
    • Licensing received phone call on 2/25/22 stating that a “little” had complained of another “little” touching him in the “penile” area. Report sent by the facility regarding this incident: Client stated when he and his peers play Hide and Seek, one of his peers touch the genital area on top of his clothing. Client stated he told the peer to stop, and the peer stopped and laughed. Client stated the peer touches his genital area only when playing Hide and Seek. When asked if anything other than inappropriate touch has been displayed on the unit, the client said no.
    • Child Abuse Hotline was called, screened out. Risk Management has reminded staff that no horseplaying is allowed on the units and reminded staff to monitor the resident’s interaction closely and keep all doors locked when not accompanied by a resident. Client and peers have been reminded to hold hands and feet to themselves to know the difference between good and bad. Client has been advised not to play Hide and Seek. Specialist visited facility on 3/1/22; Staff ratios and interim corrective action within licensing standards. It was indicated the facility did not have the Child Abuse Hotline # at this time but would get it to licensing in the near future.

  • ER Visit (Dizzy, Sprained Ankle)
    • Client reported he felt dizzy and fell to the floor while waiting to be seen by nurse practitioner. Nurse assessed and client was transferred to the ER. EKG was performed with normal findings, and doctor stated client had a sprained ankle from falling. Client was brought back to facility and will be monitored closely. No follow-up details.

  • ER Visit (Head Wound)
    • Client became aggravated due to missing phone call with a relative. Client threw water in staff’s face and physically attacked staff. While attempting to de-escalate, the client backed into a wall and hit her head (assumption). Incident not in camera view. The client had a 4cm vertical wound on head. Client was taken to hospital and received 5 staples. Investigation was conducted and will be undetermined.
    • Child Abuse Hotline was called and not accepted. No follow-up details.

  • Injury (Peer Altercation)
    • On 1/17, a client was involved in physical altercation in which he punched a peer in the head. Following altercation, client had swelling to right hand pinky knuckle. Client was given Tylenol/Ibuprofen off and on during the following days after complaining of pain but continued to have full range of motion/function. On 1/25, due to continuing complaints of pain, x-ray was ordered. Results: Acute minimally displaced fracture at the base of the 5th metacarpal. Client will be seen by physician on 1/26.

Caller advised there are three boys attacking the staff; Three boys are locked into the unit together and six kids are locked in the pod. 1 left the back door but came back inside. Officers arrived and scene.

Officer responded to facility for juvenile that had been causing issues and then left. Staff stated the juvenile had tried to attack staff and left the facility. It was discovered that juvenile never actually left the security fence and had returned inside the building prior to police arrival.

    • The FC Sheriff Department was called to facility due to 3 residents physically assaulting staff. The sheriff did not take anyone out of the facility or off the facility grounds. No follow-up details.

  • “Video footage reviewed. Staff ratio was initially 1:6 Staff then 3:6 for fight that proceeded elopement.” As soon as two additional staff left, 2 clients exited the back door. The original staff member made no attempt to stop clients from exiting back door.

    • R907.2 – Staff did not provide the level of supervision, care, and treatment necessary to ensure the safety and well-being of each child at the facility.

Walkthrough conducted; Census 49. Staff advised 2 clients were quarantined pending test results. Bathroom out of order in Angelfish; Maintenance had been called. MARs reviewed with no issues noted.

Two residents eloped; Caller has little info about them. They have been gone 1 minute; Call then stated they had returned a minute later, but thinks they will do it again. Staff called again stating Juvenile1 was in restraints and Juvenile 2 left. Officer arrived on scene.

    • Client and peer kicked door, making it open, and got outside. FC Sheriff Department arrived at facility and left once everything was calmed. No injury to client. Client placed on Unit Restriction and Physical Hold. No follow-up details.

    • Client attempted to get over facility gate, but staff intervened. After returning to the back door, the client attempted to run through another gate but failed and was placed in restraint. FC Sheriff Department at facility for assistance. Client attempted to climb over the gate again but was stopped by staff and taken back to facility. No injury to client. Client placed on Unit Restriction and Physical Hold. No follow-up details.

  • Maltreatment
    • Client was dragged in a room by his peers and wanted to get out; Client was in the room for approximately 6 minutes before he was able to walk out by his peer. Staff stayed seated the entire time while client was being forced to play an inappropriate sexualized game. Facility investigation included interviewing residents on the unit, interviewing staff, and reviewing camera footage. The allegation of neglect towards client was substantiated. The incident location was in client’s room (camera footage not available in client’s rooms). Client stated he was forced to play a game called butt raped. Butt raped is where a peer or peers will sexually hump on the target client while clothed. Staff member was terminated due to the violation of Little Creek’s Zero Tolerance Policy.
    • Specialist reviewed video on 12/29/21 which shows peers dragging client into a room from 7:05pm – 7:12pm on 12/27/21. Client is clearly heard yelling “no”. Client attempted to stay close to staff member. No video footage was available for bedroom. At no time did staff member do anything to stop anything reported in this incident. The hotline was not called regarding this incident. Facility was cited for 110.9 and 907.2. Consultation had with Risk Mgmt. regarding making hotline calls in the future.
