Sexual Assault Third Degree
Caller (Resident’s guardian) stated that resident had been sexually assaulted at facility. Caller stated Resident was sleeping in bed when Resident’s roommate woke Resident up by lying on top of Resident. Roommate pulled Resident’s pants down, asking if they wanted to have sex. Roommate then licked Resident’s vaginal area. Resident began yelling for staff members, who then showed up. Caller stated that Resident was deaf and believes that is why they were targeted. Caller also stated that Resident was assaulted by staff member; Staff member choked, restrained, and threatened Resident.

Sexual Misconduct
Indivual (“Mentor/Advocate”) in Arizona for Resident at facility reported that on a call with Resident on 11/21/2020, she was given the impression that a staff member allowed Resident to make an unapproved phone call to staff member. Individual also stated the Resident advised that a staff member had “inappropriately rubbed
Resident’s body on theirs”. Caller stated an investigation was done, but the staff member was found innocent of any wrong doings. Caller also advised that excessive force was being used on the children by staff members, and stated that Resident’s attorney has trouble contacting Resident due to staff members not allowing attorney to speak with anyone. A suspect child abuse form was completed and faxed to Arkansas State Police

Caller stated an assault took place 2 weeks prior, victim is age 12 and offender is age 18. Caller had questions about the victim wanting to press charges and whether or not a guardian would need to call.

Officers dispatched in reference to a child abuse complaint. Agency in Ohio requesting an investigation be opened on the facility. In a fax, the Ohio agency stated that a juvenile had been in an altercation with 3 other juveniles, resulting in chipped teeth, injured wrist, and broken lip. It was stated that a staff member saw the incident but did nothing to stop it. The fax stated the complaint of child abuse/neglect was against staff member. Officer contacted Crimes Against Children hotline. Agent from hotline stated they would forward the case to DHS.

Staff reported resident tried to steal badge, and hit staff in chest while trying to grab it; Staff wanted to make a report, declined medical attention.

Officer arrived at facility and saw three staff members holding resident down on the pavement of the parking lot; officer informed that resident had stabbed a staff member with a pen; resident started spitting on officers and staff; face mask applied; juvenile detention will not take resident, suggested resident be returned to her home state; while being taken into facility resident pulled fire alarm and spat on officers; officer contacted DHS to get information on which section is responsible for facility oversight, no response.

Staff reported a resident had pulled a chunk of the staff members hair out and scratched her; staff wants to press charges on resident; officer took photos of scratches and added to report file.
