Complaint Survey with POC, Revisit Survey with POC

  • Complaint #AR000029294 was in compliance.
  • Regs out of compliance –
    • N134 – Failed to ensure that a physician’s order for a physical restraint was obtained and documented for 1 client.
  • POC – All nursing employees will be re-educated by the DON on ESI documentation standards, ESI packets will be reviewed daily, facility will report ongoing compliance rates during daily leadership meeting, and a physician’s order was obtained and documented on 12/19/22 for client 1.
  • A revisit was conducted on 03.30.23, and the facility was still not in substantial compliance with the following participation requirements:
    • N142 – Facility failed to ensure an order for a physical and chemical restraint was not received at the same time for 3 clients and a physical restraint was utilized long enough to determine its effectiveness before the administration of a chemical restraint for 1 client.
  • POC – Facility will conduct mandatory re-education in-service for all RNs and LPNs led by the DON (ESI Documentation, Obtaining and Documenting Physician Orders, Physician Transcribing and Authentication Policy, ESI Policy). Daily chart audits will be conducted, DON will discuss daily compliance rate in Quality/Safety Meeting, and compliance rates will be documented/submitted in monthly Quality Patient Dashboard.

Notice of Incident, Peer Altercation, Visit Compliance Report

  • Peer Altercation
    • During an altercation with a peer, client was hit in the head by a desk. Client complained of pain to head area, with slight swelling and redness noted. Client was sent to the ER and diagnosed with contusion of scalp and head injury. Resident was placed on assault precautions and peer restrictions.
    • Licensing follow-up: Staff reported the incident happened in the classroom, and the camera in the classroom is not working. Facility reported that administration was not made aware of resident being transported to the ER until 12/16/22 when reviewing incidents. Licensing interviewed client on 01/06/23, who reported he was attacked by his peer because he was crying, and he was then taken out of the room by staff and escorted to the nurse. Client has recovered from the injury with no complaints.

Notice of Incident, Sexual Contact, Visit Compliance Report

  • Peer Sexual Contact
    • Client reported that while in their assigned room, peer pushed him on the bed and started humping him from behind (with clothes on). Client was assessed with no injury or complaints. Peer was assigned single room placement and peer restricted, and both residents were seen by their therapist. There is no camera footage due to incident taking place inside their room.
    • Licensing follow-up: Licensing received witness statements from both residents. Peer stated they were horseplaying, he pushed client on the bed and his leg wrapped around his, causing him to fall on client. Licensing spoke with staff, who stated the residents interactions are being monitored by staff.

    • Client complained of hurting his finger while playing basketball. Client was sent to the ER and diagnosed with contusion of finger. No new orders or prescriptions were given.

  • Facility visited from 12:45pm – 2pm; Census: 57. Licensing was informed by HR that the facility has 4 staff members going through orientation. Licensing reviewed background checks and all were approved. No licensing concerns noted.

  • Accidental Injury
    • Client injured his finger while attempting to rebound the ball during game of basketball. Client was sent to the ER and diagnosed with a fracture. Facility is waiting for a call back from ortho clinic regarding a follow-up appointment.
    • Licensing follow-up: Licensing was informed that client’s follow-up appointment is scheduled for 12/08/22. No licensing concerns noted.

  • Peer Altercation
    • Client complained of pain to R orbital after a physical altercation with peer. Client was sent to the ER due to bruising and swelling and was diagnosed with an injury. Resident was placed on assault precautions.

  • Peer Altercation, Self-inflicted Injury
    • Client was involved in a physical altercation with peer. Afterwards, client was still upset and began punching a window until it shattered. Client was sent to the ER due to a laceration to his wrist/hand. Client received 2 sutures and will have a follow-up appointment in 7-10 days. Client was placed on self-harm precautions and line of sight.
    • Licensing follow-up: Licensing was informed the client pulled out his sutures and was assessed by nursing, with no follow-up needed. No licensing concerns noted.

  • Medical
    • Client was sent to the ER after he lost consciousness while playing basketball. Staff initially thought client was hit in the head with a basketball, but after camera review, it was determined he was not. Upon return from ER, client stated he got too hot and passed out. Client was diagnosed with a head injury and nosebleed.
    • Licensing follow-up: Licensing was informed it is unknown how/why client overheated. No licensing concerns noted.

Elopement, Notice of Incident

  • Elopement 1
    • At 6:00 am, 3 residents ran off 100-hall and eloped after kicking open the doors by the nurses station. Staff followed until they were off the premises, and police were contacted. Clients were located by police at around 7:40 am. All 3 residents were placed on unit restriction and elopement precautions.
    • Licensing follow-up: Licensing was informed that the police department did not disclose if the residents committed any crimes when they eloped. No licensing concerns noted.

    • At 11:40 am, client ran off 100-hall by kicking through the doors to the courtyard. Client then ran through the school, kicked open several doors, and exited through the front lobby. Staff followed the resident until he was off the premises, and police were contacted. Client returned on his own at 11:55 am. No injuries were noted, and client was placed on unit restriction and elopement precautions.
    • Licensing follow-up: Facility visited on 11/17/23 and camera footage reviewed. Licensing observed the client in the seclusion room after becoming upset with his peers. After client was informed his family session was cancelled, he kicked open the exit doors to the courtyard and sits outside with staff monitoring him. Client eventually walked to the administration building and once inside, pushed past staff and walked through the unsecured doors to elope. No licensing concerns noted, as staff maintained ratio and supervision of the resident during the incident.

    • Client punched the wall in his room multiple times. Client was sent to the ER for an x-ray due to redness of the 3rd and 4th knuckles of his R hand. Client was placed on self-harm precautions.
    • Licensing follow-up: Licensing was informed there were no findings on the x-ray. No licensing concerns noted.

Elopement, Notice of Incident

  • Elopement
    • At 2:23 pm, client became upset, kicked the school door open, and eloped from the facility. Staff followed until client was off the premises, and police were contacted. Client returned to the facility on his own at 2:50 pm. No injuries were noted, and client was placed on elopement precautions.
    • Licensing follow-up: Licensing inquired about camera footage and damage to the door. Facility reported no repairs were needed to the door.

    • Client complained of neck pain, stating he doesn’t know the cause of pain. Client was taken to the ER for an x-ray.
    • Licensing follow-up: Specialist was informed on 11/15/22 that a follow-up appointment had not been scheduled for client’s neck pain. Staff will follow-up with nursing.

    • Client was taken to the ER via ambulance due to seizure-like activity.
    • Licensing follow-up: Specialist received a copy of client’s discharge plan from ER. No licensing concerns noted.

Police Report

Battery Third Degree

Staff reported that juvenile attacked a peer and after staff broke up the fight, juvenile attacked staff, then broke away and ran out the door and attempted to climb the fence. Staff then restrained the juvenile until he broke free and punched a glass cover on a light, causing it to break. Juvenile then grabbed a piece of glass as a weapon, and was restrained again by staff to remove the glass. After juvenile was placed inside the quiet room, he was restrained once again for hitting the windows and walls.

Police Report

Battery Third Degree

Staff member reported that a juvenile was seen climbing on a gate, and once staff removed him from the gate, he began attacking staff. Staff member stated that while assisting other staff, juvenile kicked her in the mid torso.

  • Facility visited from 10:55am – 2:45pm; Census: 52. Licensing viewed 3 children files.

Licensing Follow Up, Notice of Incident, Self-Injury

  • Licensing (Self-inflicted Injury)
    • Client complained of head pain from a self-inflicted injury and left posturer neck pain from hitting his head on the fence. Client was taken to the ER. Client was placed on self-harm precautions and a safety plan.
    • Licensing follow-up: Specialist observed client upset due to a room change, and client became aggressive with staff. Client was placed in a restraint, and once released, client began to hit his head on the wall of the SRU hallway. He then walked by the door and began to hit, kick, and bang his head on the door, during which staff appeared to be talking with him. No licensing concerns noted.

Maltreatment, Notice of Incident, Visit Compliance Report

  • Dual (Maltreatment)
    • Licensing received complaint on 11/14/22 regarding incident on 11/3/22: Client reported staff member put him in a restraint hold and bent his arm, trying to break it. Staff member was placed on suspension pending the investigation. Child Abuse Hotline was called and accepted.
    • Licensing follow-up on 11/14/22: CACD investigator reported they received the maltreatment report on 11/8/22 and conducted interviews the same day. Facility was cited for R110.12 for not notifying Licensing that an accepted hotline call was made against staff. Licensing reviewed video on 11/8/22 with no concerns regarding the restraint but did mention client holding his wrist. Staff involved is currently on suspension, and facility has requested an ICA for staff. Licensing reviewed staff’s personnel record which showed all regulatory checks and pre-service training was completed. Staff was previously placed on an ICA due to an investigation in which he was accused of using excessive force on a resident during a restraint hold (Video was reviewed by Licensing with no concerns noted, and staff received retraining on SAMA).
    • On 12/2/22, Licensing was informed the CACD investigation was unsubstantiated. No licensing concerns noted.

    • Client was involved in a physical altercation with a peer, and afterwards complained of pain and swelling to his thumb. Client was taken to the ER for an x-ray. Client was placed on assault precautions and peer restriction.
    • Licensing follow-up: No licensing concerns noted.

  • Licensing (Peer Altercation, Restraint Injury)
    • Client walked outside after a physical altercation with a peer and began to fight staff. Client was placed in a physical containment, during which he was aggressive and resistant. Client stated his wrist was injured during the containment and was taken to the ER and diagnosed with a sprain. Client was placed on assault precautions. Client was taken back to the ER on 11/10/22 after he removed his brace and utilized the metal piece as a weapon.
    • Licensing follow-upon 11/8/22: Specialist viewed camera footage and observed the physical restraint and client holding his wrist afterwards. Staff were not observed using inappropriate restraint techniques. No licensing concerns noted. Client has a follow-up appointment for his wrist injury on 11/15/22.
