    • Client was involved in a physical altercation with a peer, during which peer bit client on the finger leaving an open laceration. Client was taken to the ER, the laceration was glued, and a splint was applied to the right hand. Client will follow-up with his physician in 1-2 days. Residents were placed on assault precautions and peer restriction.

    • Client hurt his toe while playing basketball and was sent to the ER. Diagnosis: Contusion of multiple toes without damage to nails.

Elopement, Notice of Incident, Peer Altercation

  • Licensing (Peer Altercation, Elopement)
    • Client became physically aggressive with staff and peers, and staff broke up multiple fights between client and peers. Client then jumped the fence in the courtyard and eloped from the facility at 5:49pm. The police were notified. Client returned to the facility at 6:15pm and was assessed. Nurse noted multiple scratches to client from running in the woods, and a black eye from fighting with peers. Client was placed on elopement precautions and unit restrictions. Client was assessed for acute placement and is awaiting an open bed at various facilities.
    • Licensing follow-up: No licensing concerns noted. No acute placement as of 9/20/22.

  • Complaint #AR00028851 was substantiated, all or in part, with no deficiency cited.
  • Regs out of compliance –
    • N 145 – Facility failed to ensure the Face-to-Face Assessments for Emergency Safety Interventions documented the time they took place to ensure they were done within an hour of initiating the ESI for 1 client who was placed in physical restraints.
    • N 189 – Facility failed to ensure a staff debriefing was conducted and documented within 24 hours after 1 client was placed in a physical restraint.
  • POC – Facility will conduct mandatory re-education for all RN’s and LPN’s regarding ESI’s, review of Incident Reporting Policy, facility will conduct daily incident report audits on 3 medical records including client #1 to ensure 100% compliance until compliance is verified by OLTC, DON will discuss compliance rate daily in Quality/Safety Meetings and compliance rate will be submitted in monthly Quality/Patient Dashboard.
  • A revisit was conducted on 10/31/22 for all deficiencies cited on 09/14/22. All deficiencies have been corrected, and no new noncompliance was found.

  • Maltreatment
    • Client reported a staff member hit him during a restraint. Camera review was conducted, and the staff member was observed hitting client with a closed fist multiple times in the head area. The staff member was terminated on 9/12/22. Client was assessed by nursing, and no injuries were noted. Client stated he was hit in the eye; Nursing will monitor his eye for changes. Additional staff will be retrained on SAMA on 9/16/22.
    • Child Abuse Hotline was called and accepted. Specialist reviewed camera footage on 9/13/22 and observed 2 staff holding down his arms and lower extremities, while the 3rd staff member was observed punching the client in the head. Facility cited (R109.g, R905.4, and R905.9). CACD investigation was closed and found true.

Maltreatment, Notice of Incident, Visit Compliance Report

  • Dual (Maltreatment)
    • Complaint received on 11/14/22: Client reported a staff member pushed him onto his bed, kicked and punched him, then pushed client onto the floor causing his nose to bleed. There are no cameras in the bedroom for review, but the client stated a staff member witnessed it.
      • Child Abuse Hotline called and accepted. Licensing follow-up: Specialist spoke with staff at the facility, and informed staff that the investigator had already been to the facility to interview staff and residents, which should have alerted the facility to notify the licensing unit; Facility cited 110.12. Licensing reviewed staff’s record and saw no mention of the open investigation, retraining, or corrective action in response to the accusation. The nurse who witnessed the incident stated in a witness statement that she had no concerns with the restraint hold on 09/07/22. The alleged staff is currently suspended pending the review of an interim corrective action plan. CACD investigation was unfounded and unsubstantiated. No licensing concerns noted.

    • Client complained of a sore throat with white patches on tonsil. Client was sent to the ER and diagnosed with an acute upper respiratory infection. Client was isolated from peers for at least 24 hours.

  • Licensing (Contraband)
    • Leadership was made aware that a staff member could not find her vape pen after bringing it in and placing it on her desk. Camera review was conducted, and 3 residents were observed passing the vape pen around and hiding it in a book in the classroom. The residents have been placed on line of sight. The staff member was suspended pending further investigation and staff will receive additional supervision training on 9/2/22 on a bi-weekly basis for the next 60 days and progressive disciplinary actions up to termination.
    • Outcome: Founded. Licensing follow-up: Facility cited for R910.1 (staff placed her vape pen on her desk in sight of the residents) and R907.2 (staff failed to provide the level of supervision to ensure the safety and well-being of the residents).

  • Specialist viewed the 400 Hall entrance, fence removal, and the doors. Specialist observed the doors closing and not closing; Staff stated the doors will be repaired on 8/31/22. Where the fence was removed, metal was observed sticking out of the maintenance shop; Maintenance was contacted and agreed to repair the metal today, 8/25/22. Specialist observed classrooms 1-4. Hand sanitizer bottles have been removed from all classrooms, and dispensers are on back order and will be arriving on 9/2/22. No licensing concerns noted.
