Population Served: Males ages 12-17 and a specialized sexual rehabilitative unit for males ages 12-17

  • ER Visit – Pain from Restraint
    • Resident was placed in a restraint hold by staff after he was jumping on chairs and behind other resident’s chairs. On 6/18/21, the resident complained of shoulder pain from the restraint and was taken to the ER for further evaluation. No breaks or fractures were noted on the resident’s exam.

  • ER Visit – Peer Altercation
    • Resident was in altercation with peer, when peer bit resident on the left side of his chest. Per MD orders, resident was taken to ER for further evaluation.
    • Resident was placed on antibiotics for 10 days.

    • Staff reported to nurse that resident attempted to stab another resident with a toothbrush. Resident was assessed by the nurse and noted with superficial abrasion to right lower back.
    • Child Abuse Hotline was called, not accepted.

    • Staff can be seen on video footage pushing resident from behind.
    • Staff member was placed on a three-day suspension from work on 6/17/21. Staff will be retrained in how to handle these situations before returning to the floor to work. Child Abuse Hotline was called, not accepted.

  • Reviewed camera footage incidents that occurred at facility; Reviewed SAMA training verification for 5 staff members. Discussed facility progress on obtaining additional cameras; This has been approved and is in progress.
  • Regs not correctable –
    • R905.9 – Minimal force was not used during restraint hold with resident.
    • R905.4.g – A staff member was viewed on camera footage pushing a resident in the back during an incident.
  • TA –
    • R903.2 – Discussed need for a plan of self-care for a resident due to his history of violent or aggressive behaviors and the extent of his most recent attempt to stab another resident.

    • Peer walked up to resident with an unknown object and appeared to be sticking him on his right backside then back. Nurse noted abrasion to right upper back.
    • Child Abuse Hotline was called, not accepted.

    • Client was jumped by several peers while out in the courtyard. Nurse noted bruising behind the right ear and resident complained of blurry vision. Resident was taken to ER for further evaluation.

    • Client was jumped by several peers while out in the courtyard. Client reported to nurse inability to breathe through his nose; Nurse noted hematoma to left eye along with his nose swollen and bleeding. Client was taken to ER for further evaluation.     • Child Abuse Hotline was called, not accepted.

  • Restraint
    • Resident became escalated at nurses’ station and went into the cafeteria where he was continually escalated by staff. Resident threw a chair and was placed in a restraint hold by 5 staff members.
    • Staff member that escalated the resident by continuously grabbing the resident’s arm while he walked away was placed on suspension for three days.

    • Client reported to staff that an officer with the Forrest City Police Department pushed him into a bathroom while he was handcuffed and slapped him in the face. The police were responding to a call after another resident had an incident at the facility.
    • Child Abuse Hotline was called, not accepted.

  • Injury
    • Client was in altercation with another resident on 6/6/21 and sustained 2 abrasions to the right elbow and injury to left hand. Nurse assessed and noted a bent/crooked finger. Client sent to ER for further evaluation.
    • Inquired if there was video footage of incident and what staff/child ratio was during incident. No other info.

  • Maltreatment – Staff Verbal Abuse
    • Client reported to his therapist that staff member made him upset so client walked out of the area behind the building. Client stated that staff member followed and stated “There is no camera. So you’re lucky I don’t slap you silly.” Client also reported that staff member stated “He wished I was dead, and that the world would be better off without me.” Client reports that he pushed staff because he got too close to his face, staff did not push back. Later when asked to write a statement, client reported that staff pushed him on an air vent. Staff placed on suspension pending the investigation.

    • Resident alleged that another resident at facility touched him inappropriately. It was determined that the report does not meet the abuse criteria but will be documented. Peer was questioned about incident by staff in which he denied the allegation. No follow-up details.

  • Regs out of compliance –
    • R912.6 – No soap available to wash hands in gym bathroom. Due date 6.8.21.
    • R911.6 – Ceiling in rooms 301, 403, and 405 need to be repaired. A/C shield in dayroom 2A needs to be secured back to the wall. Bathroom door in gym needs to be replaced. Due date 7.1.21.
    • R912.3 – Sinks in all restrooms used by residents were not functioning and need to be repaired as soon as possible. Due date 6.8.21.
    • R913.5 – Room 101 and 108 need pillowcases on the pillows. Room 308 needs bedding
      for the resident’s bed. Due date 7.1.21.

  • Elopement
    • While resident was being transitioned to the front lobby, resident ran out of the front door within line of sight. Facility called FCPD and notified guardian. Resident was later returned to the facility by FCPD.

    • Client stated after refusing to show staff member which belongings were his, staff member pushed client in the back.
    • Incident not on camera; Staff reported that the cameras only record if there is motion detected so it should have recorded, but failed to do so.

    • R905.4.g – Staff grabbed resident by his arm and forcibly threw him to the ground inside the resident’s bedroom causing physical injury to the child on 5.8.21. Video footage reviewed from incident on 5.8.21 involving staff and resident; No other info.

  • Sexual Abuse
    • Client 1 disclosed that 3 times Client 2 has penetrated his rectum with his penis and
      into him. Last incident occurred 1 ½ weeks ago. Client 1 said Client 2 would corner him in his bedroom and threaten to beat him up if he would not let him do it or if he told. Facility has separated boys; Law enforcement notified. Internal investigation ongoing. Client 2 put on sexual safety plan.
    • Child Abuse Hotline was called and accepted. No video footage of incident because they are having problems with their camera system. In process of trying to get new cameras.

  • Maltreatment – Staff Abuse
    • Client came to nurse’s station crying, stating that staff grabbed him by the neck and threw him in his room. Client complained of right elbow and right hip pain; Redness noted to both areas. Staff was suspended pending investigation.
    • Child Abuse Hotline was called and accepted. Incident happened on 5.8.21 but report was not sent to licensing until 5.11.21. Staff member terminated from facility as incident was caught on camera and determined to be true. Complaint was founded as true. Agency will provide training to all child caring staff on appropriate behavior management and provide licensing with a sign in sheet by 6.19.21.

  • Regs out of compliance (reviewed 5 personnel records, walkthrough) –
    • R105.12 – No documentation of annual training in file for 1 staff since 2019 and 1 staff for 2019-2020. Due date 5.14.21.
    • R103.10 – No documentation of an initial background check for 1 staff. Due date 5.14.21.
    • R105.15.h -No references in the file for 1 staff. Due date 5.14.21.
    • R105.8 – No documentation of annual training in file for 1 staff since 2019 and 1 staff for 2019-2020. Due date 5.14.21.
    • R911.6 – Need a cover for sprinklers in 15 rooms; Tiles in the SRU shower needs to be repaired; Screen for air conditioner needs to be tightened in dayroom 2A and room 305. Due date 5.14.21, Correction date 5.13.21.
  • TA –
    • Knob on shower in the 100 hall is missing; Staff stated they do not use that shower due to only allowing 2 residents to use the shower at a time.
    • Sink in the SRU bathroom is being repaired; Staff stated the residents are currently using the sink by the nurse’s station.
    • Wallpaper in room 204 is torn; Staff stated they have replaced it several times and the resident continues to tear the paper.

  • Maltreatment – Staff Abuse
    • It was reported that on 4.23.21, client and staff member got into an argument, resulting in staff slapping client in face with an open hand. Agency suspended staff member pending the outcome of the investigation.
    • Child Abuse Hotline was called and accepted. No video of incident. Investigated closed as unsubstantiated. Multiple reports had been received on staff member abusing children; Staff stated they were aware of that and are keeping an eye on staff member to see why the residents keep saying he is physically abusing them.

Battery Third Degree

Staff stated he was called to assist other staff with Juvenile; Once Juvenile was released, Juvenile was verbally aggressive and when staff walked up to Juvenile, Juvenile sucker punched staff in his face near lip area, causing bruising.

  • Maltreatment – Staff Abuse
    • Client disclosed that Staff member pinched him for talking during quiet time; He had a bruise on his left arm, it was large and healing. Client disclosed this had also happened to peer; Client was inconsistent with time of incident. Peer stated he was talking during quiet time when Staff member pinched him on his neck and shoulder, leaving bruises. Staff suspended pending outcome of investigation.
    • Child Abuse Hotline called and accepted, unsubstantiated. No video of incident, facility getting new cameras. Staff member denied allegations, he stated he helped client after client fell out of chair by grabbing client’s arm.
