Police Report

Battery Third Degree, Use of Force

Upon officers arrival, staff stated 3 juveniles were trying to get into dorm room 2 because peers were egging them on from inside. Staff stated after juveniles were grabbing wristbands to gain access, they were separated and medication was administered to J1 to calm her down. J1 charged at officers and started swinging, so she was placed in handcuffs and escorted to patrol unit. Staff stated J1 had pushed a cart at her, busting her lip, and kicked her upper shoulder/chest area. J1 was transported to ACH via MEMS for treatment (suicidal ideations & psychiatric health).

    • Client reported a peer had slapped her on the buttocks and touched her breasts. Client was unable to provide a date/time of when the incident occurred.
    • Child Abuse Hotline was called, not accepted. Precautions were put in place to keep peer 12 feet away from client. Licensing follow-up on 4/7/22: Director of Risk Management stated there exists no evidence to substantiate or refute allegations.

Information Report

Caller reported her daughter (18y/o) walked away from facility on 3/28/22 and stated she has some mental health issues. Officers located individual on 3/28/22 and she was transported to Baptist for a separate incident.

  • Suicidal
    • A suicide attempt occurred at the facility on 03/28/22 that was not reported (reported to DCCECE on 07/26/22). The records indicate that a client tied a shirt and towel around their neck.
    • Licensing follow-up: Facility visited on 07/26/22 & 07/27/22; Report from facility states that client was upset they could not a DVD player and began scratching their left forearm with their fingernails but did not break the skin. Client then went into room and attempted to wrap a sweatshirt around their neck. This was observed on camera and staff immediately intervened. Licensing records indicate that Licensing was not notified of this incident prior to complaint.

  • No regs noted out of compliance. Program Director of facility interviewed: He reported that no clients since the beginning of the month have mentioned suicidal ideation or thought of self-harm. The protocol if such happens is that all staff are notified, and clients are assessed by nurse and therapist.

Officers secured the scene for MEMS for an aggressive juvenile that the facility wanted taken to ACH for evaluation.

  • ER Visit (Self-inflicted Injury) – Client became dysregulated and punched a wall with his hand. Client was transported to ER and received x-ray that determined client had a slight fracture of the fifth metacarpal of the right hand. Client’s hand was not placed in a cast. Follow-up appointment scheduled with an orthopedist on 2/27/22.

Census: 15. Buildings and grounds conducted for Destiny House and MARs checked for 5 clients. Records reviewed for 10 clients with no licensing concerns.

Notice of Incident

  • Maltreatment
    • Client was in the cafeteria, flipping tables and throwing books. Staff member was picking up the books when client stepped in front of him. Staff put his hand on client’s back and started to walk away. Client said, “Oh, did you just push me” and swung at staff’s head. Staff lunged and grabbed client. Nearby staff intervened. Client stated staff choked her, and she had red marks on her clavicle area. There was also a scratch on her cheek (unknown if it came from this incident).
    • Child Abuse Hotline was called and accepted. Staff was terminated. Specialist visited facility on 2/10/22 and viewed video. Staff was clearly seen pushing client as he walked by. This seemed to aggravate client who escalated and lunged at staff. Staff responded by lunging back, grabbing at client. Facility cited for licensing violations.

      • 905.4g – The following shall not be used, including as discipline: Physical injury or threat of bodily harm.
      • 907.2 – Child caring staff shall be responsible for providing the level of supervision, care, and treatment necessary to ensure the safety and well-being of each child at facility.

Staff stated 2 juveniles were in physical altercation and the rest of the residents are refusing to return to their rooms. Both juveniles were “talking in circles” and were vague while speaking with officers. No visible injuries observed.

  • Maltreatment
    • Client was out of control, attacking peers, throwing things, and threatening others. Client attacked peer and punched staff member in the face. Client was placed in a CPI restraint by 2 staff for about 10 minutes. When client was released, she was upset because a staff member involved in the restraint was a male and it triggered her past. Client then alleged that same staff banged her head against the wall 4 times and choked her. No injures noted after nurse assessment. Other staff members that were present indicated they did not observe the abuse that client alleged occurred. On 1/8/22, client indicated the same allegations against that staff member. Client’s guardian indicated that the client has a history of making similar accusations that were false.
    • Child Abuse Hotline was called and accepted. Staff member was suspended pending the outcome of the investigation. Specialist visited facility on 1/11/22 and viewed video; Two staff initiated the restraint hold which is then taken off camera. At no time was client heard saying she is hurt or being hurt. At no point is improper restraint nor ratio out of licensing standards during video. CACD investigation unsubstantiated. Staff returned to work after the investigation.

Buildings and grounds conducted for Destiny’s House; Census 17. Leak observed under washing machine which maintenance (who were present) was aware of and indicated they would fix. MARs checked for multiple residents. Two residents had missing entries; Staff indicated the clients were on therapeutic leave thus no med administration entries were made.

Officers responded to facility and searched the outside of the business for signs of suspicious activity with negative results. All doors and windows seemed secure.
