Methodist Children’s Home operates multiple programs on a single campus. Police responses to this campus often do not identify the program they are responding to. All reports plausibly related to the PRTF or Qualified Residential Treatment Program/Group Home (QRTP) have been included here. Where we can be certain the response was to the QRTP it is noted.

Contact with family (Calls and visit schedule): Clients have regularly scheduled phone call opportunities. The number of actual calls depends on the clients wish to utilize these opportunities. In person visitation (assuming no quarantine precautions) is available every weekend and can be scheduled at other times as needed by the family or guardian.

Police Report

Battery Third Degree

QRTP – Staff stated they heard a loud commotion at end of hall and located J1 in J2 and J3s room. J1s nose was bleeding and had been fighting J2 who accused him of stealing money. J1 also stated that morning, J2 and J3 were fighting. J2 stated he did not steal J1s wallet, but later returned it to officer to give to J1. J3 stated after J1 was calling him a pedophile and hitting him, he picked up J1 and slammed him on the ground. J3 had a busted lip.

  • Reviewed 10 personnel records and 3 children’s records.
  • TA –
    • 604.1.h – Four out of five online files were missing immunizations; Staff provided those during visit. Staff stated that staff will be trained in putting those in the system.

Criminal Mischief First Degree

Staff advised J1 was throwing rocks at her vehicle and the property, busting out the windows. Staff requested J1 be transported to ACH and stated she as well as facility wants to seek charges on J1. J1s hand and nose were bleeding; MEMS responded and transported J1 to ACH.

QRTP – Pulaski County JDC requested officer to respond to facility to pick up J1 on warrant. Officers transported J1 to JDC.

Buildings and grounds visit was conducted. MARs reviewed for 5 girls and 3 boys; No concerns noted. Gathering room and common areas clean. Census 14.

Assault Third Degree

Staff stated while trying to break up a fight between J1 and J2, J1 pushed staff into a door. J1 stated J2 came into his face and swung at him so they began fighting. J2 stated J1 had been talking about him and he got tired of it so he swung at him.

Information Report

Staff stated 3 Juveniles had returned to the facility after being gone unknowingly. Staff stated they noticed the Juveniles gone at 0115 hours. Staff stated the Juveniles were caught at 0220 hours coming back.

Notice of Incident

  • Fight
    • Client and peer started fighting, and client was kicked in the knee a few times before staff were able to intervene. Client and peer calmed down and client was assessed by a nurse. An X-ray was done on client with no issues found. No follow-up details.

  • Multiple deficiencies noted. Plan of Correction required to be completed within 30 days.

Assault Second Degree, Terroristic Threatening Second Degree

Staff advised Juvenile1 had been throwing a tantrum all day and throwing objects at staff; Staff stated J1 had said he will damage vehicles. Another staff verified, and said J1 hit him in the leg with a broom. J2 stated J1 threw CDs at him. No injuries noted. Staff stated J1 be transported to ACH; MEMS responded.

Battery Third Degree, Runaway, Theft of Property

Staff advised Juvenile ran away from facility after attacking staff and stealing keys. Staff stated Juvenile became upset when he asked her to sit down, threw her shoes at him, stole his keys, and used them to leave the building. Officers circulated the area with negative results. On 11/17/21, Conway PD advised they have the Juvenile and are contacting DHS to pick up Juvenile.

Specialist reviewed resident/staff ratios, halls, MARs, and 3 residents records with no concerns found. Required training that has been done has been sent via email today.

Staff advised 2 Juveniles were fighting. Upon arrival, staff advised they had worked it out and did not need a report.

Staff advised Juvenile1 and Juvenile2 were in physical altercation; J1 and J2 stated they were throwing rubber bands at each other and began fighting. No injuries observed.

Notice of Sanction

  • 10.01.21 Actions: DMS hereby issues the following sanctions to United Methodist Children’s Home until deficiencies identified in the IOC are resolved, and an acceptable CAP is provided and been put into place:
    • DMS/DPSQA review and possible revision of the Corrective Action Plan which must be submitted to AFMC by close of business on October 6, 2021.
    • Suspension of provider referrals to your facility
    • Placement on high-priority monitoring
    • Referral of the matter to the Arkansas Office of Medicaid Inspector General for review
    • Recoupment of payments made for services determined not to be medically necessary or that fail to meet professionally recognized standards for healthcare

Corrective Action Agreement

  • The following non-compliance areas have been cited during the past six months:
    • 907.2 Ratio & Supervision – Facility was cited for not providing care and treatment necessary to ensure the safety and well-being of each child multiple times since 1/1/2021.
    • 905.4 (g) – Facility was cited for the use of physical injury or threat of bodily harm as a form of behavior management multiple times since 1/1/2021.
    • 905.4 (h) – The following actions shall not be used, including as discipline: h. Humiliating or degrading action.
    • 905.9 – Facility cited for staff failing to use minimal force and time necessary during restraints performed on residents.
    • 905.11 – Facility cited for nursing staff administering chemical restraints to children that did not require emergency behavioral intervention on video footage or photos.

  • Census: 21 total with 1 female out at an acute facility. Ratios reviewed. Milieu, sleeping quarters, and classrooms were in good order.
  • Specialist checked med logs for 4 residents with no regs out of compliance.

QRTP – Juvenile1 stated that Juvenile2 bullies him; J1 stated J2 asked him to get cigarettes and when he did, staff asked where the smoke smell came from. J1 stated he told on J2 so he wouldn’t get in trouble. J1 stated J2 followed him outside and began punching him; No injuries observed. J2 stated J1 was bullying other kids so he decided to “handle it.”

Staff stated Juvenile1 was acting out and threatening to drink hand sanitizer to harm himself. MEMS was called and responded to scene. Staff and MEMS agreed J1 would stay at facility and speak to counselor.

QRTP – Staff stated Juvenile1 started a fight with Juvenile2. No injuries observed. Staff stated Juvenile3 broke the fight up and J1 continued to get in J3s face. J1 stated J2 was talking about how he could beat up certain people at facility, and attempted to shut the refrigerator door on him while he was getting milk. J1 stated J2 pushed him first and that’s when the fight started. J2 stated he was protecting himself and J1 approached and hit him first.

Assault First Degree

Staff stated Juvenile had been kicking several individuals at facility. Staff advised when he told Juvenile to stop, Juvenile kicked him 3 times in the leg. Staff stated when he placed Juvenile in office, Juvenile began kicking at the door trying to leave. Juvenile stated to Officers that he was only playing.

Incident Report

  • Incident-Founded-incident involving child IC and another child getting into a verbal altercation:
    • 905.4.c- IS made derogatory comments toward the child.
    • 905.4.d- The following actions shall not be used, including as discipline: d. Derogatory comments about the child, the child’s family, race, or gender. (IS used obscene language).
    • 905.4.h-telling the child that staff member was glad he didn’t care if he went to jail.

Visit Compliance Report

Specialist and Program Coordinator conducted inspection and reviewed med logs with no regs out of compliance. Girl’s group room had 3 staff and 16 kids (1 girl at dentist); Boy’s milieu had 1 staff to 4 kids. No issues found during walk-through.
