Licensing Follow Up, Notice of Incident, Self-Injury

  • Licensing (Self-inflicted Injury)
    • Client complained of head pain from a self-inflicted injury and left posturer neck pain from hitting his head on the fence. Client was taken to the ER. Client was placed on self-harm precautions and a safety plan.
    • Licensing follow-up: Specialist observed client upset due to a room change, and client became aggressive with staff. Client was placed in a restraint, and once released, client began to hit his head on the wall of the SRU hallway. He then walked by the door and began to hit, kick, and bang his head on the door, during which staff appeared to be talking with him. No licensing concerns noted.

Maltreatment, Notice of Incident, Visit Compliance Report

  • Dual (Maltreatment)
    • Licensing received complaint on 11/14/22 regarding incident on 11/3/22: Client reported staff member put him in a restraint hold and bent his arm, trying to break it. Staff member was placed on suspension pending the investigation. Child Abuse Hotline was called and accepted.
    • Licensing follow-up on 11/14/22: CACD investigator reported they received the maltreatment report on 11/8/22 and conducted interviews the same day. Facility was cited for R110.12 for not notifying Licensing that an accepted hotline call was made against staff. Licensing reviewed video on 11/8/22 with no concerns regarding the restraint but did mention client holding his wrist. Staff involved is currently on suspension, and facility has requested an ICA for staff. Licensing reviewed staff’s personnel record which showed all regulatory checks and pre-service training was completed. Staff was previously placed on an ICA due to an investigation in which he was accused of using excessive force on a resident during a restraint hold (Video was reviewed by Licensing with no concerns noted, and staff received retraining on SAMA).
    • On 12/2/22, Licensing was informed the CACD investigation was unsubstantiated. No licensing concerns noted.

Licensing, Notice of Incident, Peer Altercation

  • Licensing (Peer Altercation)
    • Client was involved in a physical altercation with a peer, and afterwards complained of pain and swelling to his thumb. Client was taken to the ER for an x-ray. Client was placed on assault precautions and peer restriction.
    • Licensing follow-up: No licensing concerns noted.

Notice of Incident, Peer Altercation, Restraint Injury

  • Licensing (Peer Altercation, Restraint Injury)
    • Client walked outside after a physical altercation with a peer and began to fight staff. Client was placed in a physical containment, during which he was aggressive and resistant. Client stated his wrist was injured during the containment and was taken to the ER and diagnosed with a sprain. Client was placed on assault precautions. Client was taken back to the ER on 11/10/22 after he removed his brace and utilized the metal piece as a weapon.
    • Licensing follow-upon 11/8/22: Specialist viewed camera footage and observed the physical restraint and client holding his wrist afterwards. Staff were not observed using inappropriate restraint techniques. No licensing concerns noted. Client has a follow-up appointment for his wrist injury on 11/15/22.

  • Licensing (Sore Throat, Fever)
    • Client was taken to the ER after complaining of a sore throat and fever.
    • Licensing follow-up: No licensing concerns noted

Licensing, Notice of Incident, Peer Altercation

  • Licensing (Peer Altercation)
    • Client was playing “bloody knuckles” with a peer; Client was redirected and taken to the nurse’s station. Nurse noted faint bruising and edema to client’s hand, and client was taken to the ER. Residents have been placed on assault precautions and peer restricted.
    • Licensing follow-up: Specialist was informed on 11/4/22 that assault precaution and peer restriction were still in place. No licensing concerns noted.

Elopement, Maltreatment, Notice of Incident, Visit Compliance Report

  • Dual (Maltreatment, Elopement)
    • Client eloped from the facility after a fire alarm was activated, unlocking all doors at the facility. Client disclosed that he eloped because Staff 1 hit him, and while trying to elope, Staff 2 choked him by placing his hands around his neck, restricting his breathing. Staff were placed on suspension pending the investigation.
      • Child Abuse Hotline was called and screened out, but later accepted. Licensing follow-up: Specialist spoke with staff and informed them that even though the call was screened out initially, when it became accepted the facility was responsible for reporting the call to the licensing unit the next business day; Facility cited for 110.12. No video footage is available due to time lapse between when the incident occurred and when licensing received notification. Upon review of personnel files, Staff 1 received disciplinary action for “bullying and antagonizing residents” on 07/19/22 and was retrained on SAMA. Staff 2 was involved in an open maltreatment report from 09/07/22 (not mentioned or addressed in his personnel file). Staff 1 is being terminated on 11/17/22, and Staff 2 is suspended pending the review of an ICA requested by the facility. Licensing also discussed with staff that the information regarding staff maltreatment was not included in the original report to Licensing, and provided education that serious occurrence forms must contain all relevant information.
      • CACD investigation was unsubstantiated. No licensing concerns noted.

Elopement, Notice of Incident, Peer Altercation

  • Dual (Peer Altercation, Elopement)
    • Client was involved in a physical altercation with peer and became aggressive with staff. During the altercation, the fire alarm was disabled, causing all the doors to unlock. Client was able to exit the building at 7pm with staff following, and staff attempted to contain him. Due to being off grounds, staff were instructed to release the client and he continued to run. Police were notified and assisted with searching for the client. Alarm company and maintenance were notified to assist with relocking all doors. Upon camera review, client was seen entering the school building and testing all doors to see if they would open, then entered the courtyard and sat by a door until he was found by maintenance conducted a check on all doors at 7:30pm. Client was assessed (no injuries) and placed on elopement precautions.
    • Licensing follow-up: Specialist was informed that police were called to assist but did not find the client. Client was found by staff and no police report was filed.

    • Client complained of finger pain, stating he jammed it playing basketball. Client was sent to the ER for an x-ray.

    • Client complained of lower back pain, stating it was hurting when he woke up. Client was taken to the ER.

Licensing Follow Up, Notice of Incident, Self-Injury

  • Licensing (Self inflicted injury)
    • Client swallowed a nail or screw he found in the hallway and refused to tell staff where he got it. Client was sent to the ER. Maintenance will conduct a safety sweep twice a day to ensure no screws, nails, or other supplies are laying around. Management will also conduct a daily check. Client was placed on self-harm precautions. On 10/31/22, a follow-up x-ray was ordered to identify if the nail/screw had passed.
    • Licensing follow-up: Specialist was informed there is no camera footage due to client not stating a true timeframe of when or where he swallowed the nail/screw. Facility reported client had a follow-up appointment on 11/16/22 and the nail/screw passed. No licensing concerns noted.

Licensing Complaint, Notice of Incident

  • Licensing (Complaint)
    • Complainant stated her son has been in 7 fights, with 1 consisting of 8 17-year-old boys jumping her son. Complainant stated her son’s life is in danger at this facility where his caseworker placed him.
    • Licensing follow-up: Specialist was able to contact the complainant on 11/14/22. Facility visited on 11/17/22 regarding outside complaint:
      • Resident was not being appropriately supervised by staff.
      • Staff were allowing resident to be beat up by peers and not intervening.
      • Resident has been involved in 9 altercations with peers.
      • Staff member reportedly twisted resident’s arm, causing a sprained wrist (see 11/03/22 Notice of Incident for more info; Investigation unsubstantiated).
      • Staff allegedly told resident he would “beat him so badly he wouldn’t be able to walk”.
      • Staff put resident in a headlock after he attempted to elope after another staff hit him (see 10/31/22 Notice of Incident for more info; Investigation unsubstantiated).
    • Licensing was informed by staff that in October, the resident was in 6 altercations with peers and 2 incidents in which resident attacked staff. Video footage of the incidents is no longer available due to automatically deleting after 14 days. The Program Coordinator was made aware that the incident reports and ESI packets are now considered legal documents by the facility, so coordinator cannot obtain a copy; Program Coordinator will seek legal guidance. Both maltreatment investigations were closed as unsubstantiated. Licensing complaint unfounded.

Notice of Incident, Peer Altercation, Sexual Contact, Visit Compliance Report

  • Dual (Peer Altercation, Sexual Contact)
    • Peer reportedly put client in a headlock and repeatedly punched him. Client said he asked him to stop but he didn’t. Client then stated a peer held him down while another peer stuck a comb up his rectum. Client was assessed by nursing and sent to FCMC. Client will be moved to a different classroom and program hall from alleged peer and residents were peer restricted. A camera review was conducted, and staff will receive disciplinary actions and supervision training.
    • Licensing follow-up: Specialist reviewed camera footage on 10/27/22 and observed residents walking up and down halls entering different bedrooms. The 2 staff members were sitting in the hallway facing each other and did not prevent residents from entering unassigned bedrooms. Specialist was unable to determine what took place due to the bedrooms having no cameras. Specialist reviewed witness statements and cited the facility for R907.2 (staff failed to provide the level of supervision to ensure the safety and well-being of each resident). Child Abuse Hotline report was screened out. Licensing outcome: Founded. 

Police Report

Rape

Officer dispatched to the ER for a rape report. Juvenile stated that on 10/24/22, he was held down by peers while being punched and peer put his knee on juvenile’s neck until he was able to break free. A comb was also used to scratch parts of his body. After telling peer to leave his room multiple times, a staff member entered and told peer to leave the room, but peer refused. Staff then left and the attacks resumed. Juvenile then stated while he was in a headlock, peer forcibly penetrated his rectum with the comb. Staff at facility reported that peer has threatened to kill juvenile if peer got in trouble for what happened. Officer contacted the Arkansas Child Abuse Hotline on 10/25/22.

Licensing Follow Up, Notice of Incident, Self-Injury

  • Licensing (Self-inflicted Injury)
    • Client punched a wall multiple times and complained of pain and swelling to his hand. Client was taken to the ER and diagnosed with a mildly displaced fracture to the fifth metacarpal. Client has a follow-up appt. scheduled with an orthopedic specialist.
    • Licensing follow-up: Client’s appointment is scheduled for 10/26/22. No licensing concerns noted.

Elopement, Notice of Incident, Self-Injury

  • Licensing (Self-inflicted Injury, Elopement)
    • While outside, client climbed over the fence and eloped off grounds at 4:34pm. Client was found by police, attempting to run into traffic and had cut his wrist, causing minor abrasions. Police returned client to facility at 5pm. Client was assessed by nursing and abrasions cleaned. Client was placed on 1:1 precaution for elopement risk and self-harm precautions. Staff involved will receive disciplinary actions up to termination and additional training on supervision.
    • Licensing follow-up: Specialist was informed the client had self-harmed with glass he found outside of the facility. Staff are scheduled to be retrained on 10/28/22. Specialist followed up on 10/31/22 for documentation of training. No licensing concerns noted.

Notice of Incident, Strep Throat

  • Licensing (Strep Throat)
    • Client had a temperature of 102 and complained of an itchy/scratchy throat. Client was taken to the ER and diagnosed with positive strep, rapid group A screen. Client will be isolated from peers for 24 hours and will wear a mask to prevent spreading.
    • Licensing follow-up: No licensing concerns noted.

Disorderly Conduct, Licensing Follow Up, Notice of Incident

  • Licensing (Disorderly Conduct)
    • Around 11pm, client asked staff for clippers to fix his haircut. Client was given the clippers and clipped his hair while in staff supervision. Client then walked down the hallway and entered multiple rooms, clipping a patch of hair from 6 residents’ heads. Once the clippers were given back to staff, client became upset and broke the plexiglass covering the TV in the dayroom and tried to attack staff. Police were contacted and detained client to get the plexiglass from him. Client was placed on LOS and peer restriction from the 6 residents. Going forward, clippers will only be available to use during the weekday with management oversight.
    • Licensing follow-up: Specialist visited the facility on 10/20/22 and reviewed camera footage. Client was seen with the clippers pretending to cut staff’s hair, and staff could be seen talking with the client with his hand out for the clippers. Client proceeded to enter different rooms with the staff member following him in and out of the bedrooms. There are no cameras in the bedrooms. Specialist observed the client was not left unsupervised. Specialist was informed the clippers are provided to residents with facial hair for them to trim their faces. No licensing concerns noted.

Police Report

Aggravated Assault

Officer responded in reference to a juvenile threatening staff with a knife. Upon arrival, staff had juvenile held on the ground and officer then handcuffed juvenile. Staff reported the juvenile became irate and began breaking the plexiglass window protecting a TV. Juvenile then picked up a piece of the plexiglass to use as a weapon and threatened to cut staff. Staff were able to disarm juvenile until officer arrived. Juvenile was relocated to solitary confinement.

Licensing Follow Up, Notice of Incident, Sexual Misconduct

  • Licensing (Sexual Misconduct)
    • Client took a staff member’s phone and placed it inside his pants. Per camera review, staff followed client to his room to get the phone back, and client is seen rubbing his genital area and gesturing for staff to retrieve it from his pants. After client gave staff the phone, he slapped the staff member’s buttock. Staff reached around to grab the client’s hand to stop him, and client attempted to throw her on his bed. Staff was able to get away from the client and leave the room. Client was placed on an updated specialized sexual plan and sexual precautions. Client is housed on SRU in a single room. The staff member involved will no longer be assigned to work with the client and was offered a Life Assistance Program.
    • Licensing follow-up: Specialist was informed the staff member left her phone in the hallway in a chair under a binder. Client waited for staff to walk to a peer’s room and took the phone. No licensing concerns noted.

    • Client had a temperature of 102.7 upon admission and was taken to the ER. Diagnosis: Encounter screening, unspecified. Client was isolated for 24 hours and monitored by nursing.
