Accidental Injury, Notice of Incident

On 6/24/2023, client reported she closed the bathroom door on her left hand. Centers’ medical staff assessed client’s left hand and noted the area was red and the hand was slightly swollen. Client’s left hand was treated with an ice pack, and client was given ibuprofen. Client continued to complain about pain in her left hand so out of an abundance of caution, centers’ staff transported her to Arkansas Children’s Hospital (ACH). Once at ACH, medical personnel there conducted x-Rays of left hand and determined there were no fractures present. After client’s medical evaluation, she was transported back to EMAC. Visit Compliance Report

Licensing Specialist completed buildings and grounds at EMCC on the following areas: the dorms (North, south, new, and east), administration hall, dining room area, playground, and nurse’s station. Licensing Specialist observed two (2) vans on the grounds. The lawn was well kept with no debris. There were staff members walking on the grounds between the two (2) buildings. Licensing Specialist was escorted by Mr. Mike (Lead program manager). The administration hall was clean. Licensing Specialist observed different staff members walking in the hall or in their offices. Licensing Specialist observed housekeeping cleaning the dining room area. Licensing Specialist observed the playground area. Day treatment residents were outside on the playground during this visit. There were no residents present during the walkthrough of the dorms. EMCC residents were in the classrooms. Licensing Specialist observed the cozy corner, bedrooms, laundry room, recreational closet, storage cabinets (Hygiene products, games, movies, and cleaning products), bathrooms, the rage room, and day areas of the dorms. All bathrooms were clean with a fresh smell of cleaning products. The bedrooms were organized, and some beds were without bedding due to it being laundry day for those residents. Licensing Specialist observed wall decorations (Fat heads) on the walls of the dorms and zone regulations. Each dorm has their own pitcher to supply water for the residents. Mr. Mike informed Licensing Specialist that each resident has their own water bottle and are cleaned daily. Licensing Specialist observed the following documentation on the walls: residents’ rights, emergency escape plan, menu, weekend incentives, summer and weekend schedules. Medical, Notice of Incident

On 6/22/2023, client was in the bathroom when she reported experiencing severe abdominal pain. The nurse was called and conducted an abdominal assessment of client. The assessment showed rebound tenderness and wincing and screaming to the touch. Out of an abundance of caution, MEMS ambulance service was called and transported to Arkansas Children’s Hospital (ACH) for further evaluation. Once at ACH, medical personnel there conducted several tests on client, one of which revealed a cyst of the right ovary. The attending provider ordered to take two tablets of aygestin every day for the next ten days to help relieve her condition. After client’s medical evaluation, she was transported back to EMAC. Complaint, Notice of Incident, Visit Compliance Report

Reported that staff is giving kids melatonin with their medications that she brings from home and sprays the kids with melatonin. Licensing narrative: Licensing Specialist reviewed the complaint for licensing concerns. Licensing Specialist visited the facility and reviewed the MARS. Licensing Specialist spoke with the DON and inquired about the standing order process and the pre-Approved list of medication and was informed that melatonin was not on the pre-Approved list and the nurse would have to consult with the medical provider before administering the medication. Licensing Specialist requested a copy of the pre-Approved list, consent form, and other documentation regarding standing order. Licensing Specialist spoke with three (3) residents at EMCC regarding their medications and later spoke with nine (9) residents at EMCC regarding their medications. 8/14/2023, Licensing Specialist informed by facility that referral # [Redacted] was found true and staff members involved will be terminated. 8/18/2023, Licensing Specialist followed-Up with investigator and informed case was closed, founded. Regulations out of compliance: 109.1.G – actions of the nurse giving nonprescribed medication to residents could be viewed as dangerous to the residents. 908.8 – nurse was using gummy and spray melatonin on residents that were not prescribed the medication and no documentation was maintained on when the residents received the medication. On 6/20/23, client reported she was having significant cramping and severe abdominal pain. Client is approximately 15 weeks pregnant. Out of an abundance of caution, mems ambulance service was called and transported client to the UAMS Medical Center emergency room. Once at UAMS , medical personnel there conducted several lab tests and imaging scans, all of which returned normal. Client was given zofran and tylenol to help with her abdominal pain. After client’s medical evaluation at UAMS , she was transported back to EMAC. Licensing narrative: Licensing Specialist reviewed provider reported incident for licensing concerns.

On 6/19/2023, client was at an appointment with her gynecologist for a routine exam when she began to experience abdominal pain in her right lower quadrant. Client was transported to Arkansas Children’s Hospital (ACH) by Centers’ staff for further evaluation. Once at ACH, medical personnel there conducted several tests (Urinalysis, numerous imaging scans) all of which returned normal. The attending physician advised client should take tylenol and motrin for any discomfort. After client’s medical evaluation at ACH, she was transported back to emac. Suspicious Person

Officers responded to the listed address in reference to a suspicious person. Officers made contact with Deputy Tripp Cleburne, a county deputy working in an off-duty capacity at this location. Deputy Tripp advised employees of the business told him there was a black Volkswagen occupied by a black male sitting in the parking lot. Deputy Tripp advised the employees told him the male subject, later identified as [REDACTED], has been known to be armed with a pistol. Deputy Tripp advised he did not approach the vehicle and called ‘911’ for police assistance. Deputy advised the business advised him that a female employee does have an order of protection against [Redacted]. After speaking with Deputy Tripp, officers made contact with [REDACTED]. [REDACTED] advised he was waiting to meet a female subject that works at the location and asked him to meet her here. Officers then made contact with CEO of the Center for Youth and Families. CEO advised she did want [REDACTED] banned from the property. After conducting a record check on [REDACTED], officers advised [REDACTED] that he was banned from the property and would be charged with criminal trespassing if he returns. Officers stood-By while [REDACTED] left the scene without incident.

Terroristic Threatening First Degree

Officers responded to the listed location in reference to a property check call. Upon arrival, officers made contact with the caller. Caller advised she has a protection order against her ex-Boyfriend. Caller advised she is not sure if the subject has been served with the protection order or not. Caller advised ex-Boyfriend has been coming to her job, circling the parking lot, and making threats to her over the phone. Caller advised ex-Boyfriend advised her to come outside. Caller advised ex-Boyfriend stated he would shoot her and the kids inside, while on the phone with him. Caller advised ex-Boyfriend left the location before police arrival. Officers was unable to make contact with ex-Boyfriend due to him no longer being on scene. Officers provided caller with the incident number. Officers advised caller to call police if returns. Officers circulated the surrounding parking lots for with negative results.

Officers responded to the listed location in reference to a suspicious person call. Upon arrival, officers made contact with [REDACTED], who advised she observed subjects outside the location causing a disturbance. [REDACTED] advised her employees observed a black handgun. [REDACTED] mentioned that the suspicious persons were driving a black Volkswagen; license plate [REDACTED]. Officers provided [REDACTED] with the incident number to follow up with. No further police action taken.

Notice of Incident, Peer Altercation

On 6/04/2023, client was playing outside on the playground when he hit one of his peers with his hand. After being hit by client, the peer picked up a rock and struck client in the left side of the head. The two clients were separated by staff and one was taken to the nurses’ station to be assessed. Client sustained a small cut to the left side of his head that was bleeding and had a small amount of swelling surrounding the area. Centers’ staff transported to ACH for further evaluation. Client treated for a laceration of the scalp and closed the wound with a single staple. After client’s treatment at ACH, he was transported back to EMCC by Centers’ staff. Client and his peer were placed on Assaultive Precautions due to this incident. Licensing Narrative: Licensing Specialist reviewed provider reported incident for licensing concerns. Licensing Specialist informed that Center’s medical personnel would remove the staple from the resident’s scalp.

On 6/02/2023, client began to experience a mild case of asthma induced shortness of breath. Centers’ medical team treated client with Albuterol and a nebulizer device. After both treatments, was still experiencing some shortness of breath. Sent to Arkansas Children’s Hospital (ACH) by MEMS for further evaluation. Diagnosed client with shortness of breath caused by anxiety. The attending physician at ACH believed a large component of this incident was psychosomatic in nature. ACH medical personnel gave two updraft treatments. After client’s medical evaluation at ACH, she was transported back to EMAC by Centers’ staff. Licensing Narrative: Provider reported incident received and reviewed for licensing concerns.

Acute Placement, Notice of Incident

On 6/02/2023, client became dysregulated and displayed the following behaviors: labile mood, not eating, and aggression. The decision was made to seek an acute placement for so she could receive a higher level of care. On 6/02/2023, at approximately 2015 hours, was transported to Bridgeway Behavioral Health by MEMS. Client is DCFS placement at The Centers. After her treatment at Bridgeway, client will return to EMAC. Licensing Specialist informed that resident would be returning to the facility once discharged.

On 5/29/2023, client began to experience a mild case of asthma induced wheezing. Centers’ medical personnel treated with two puffs of Albuterol. After approximately one hour, client was still experiencing some shortness of breath. The Centers’ medical team made the decision to send to Arkansas Children’s Hospital (ACH) for further evaluation. Centers’ staff transported to ACH. Diagnosed with moderate persistent asthma with exacerbation. After client’s evaluation at ACH, she was transported back to EMAC by Centers’ staff. Licensing Narrative: Licensing Specialist reviewed provider reported incident. No licensing concerns noted.

Notice of Incident, Psychiatric Evaluation

On 5/22/2023, client became dysregulated, which resulted in staff having to place her in several Emergency Safety Interventions (ESI) to keep her and others safe. Client is approximately ten weeks pregnant. Due to client’s high risk behaviors, the medical team made the decision to send her to Arkansas Children’s Hospital (ACH) for further evaluation. MEMS was called to transport client to ACH. When MEMS contacted ACH to give them a radio report of client’s transport, ACH denied clients transport to their ER. MEMS then transported client to the UAMS Medical Center. Once at UAMS, client was observed and evaluated for several hours by medical personnel. Client was determined to be stable by UAMS medical personnel and was transported back to EMAC. Client is a DCFS placement at The Centers. Client did not sustain any injuries because of this incident. Licensing Narrative: Licensing Specialist reviewed provider reported incident. No licensing concerns noted.

Notice of Incident, Peer Sexual Contact

On 5/22/2023, client told a Centers’ staff member that one of her peers, tried to force her hand down her pants. Client said she told to “stop” and the other client left the dorm room. Client said [REDACTED] touched her inappropriately approximately two weeks ago, but she did not report it to staff out of fear the other client would harm her. This incident was reported to the Child Abuse Hotline, and the reported allegations were accepted. Client was placed on sexual precautions due to this incident. Clients will not be allowed on the same dorm moving forward. Licensing Narrative: 5/26/2023, Licensing informed that residents were separated on different dorms. Documentation provided on sexual acting out precautions and line of sight precautions. Licensing Narrative: Licensing Specialist informed no witness statements were taken but nurse’s note would be provided. 7/24/2023, Licensing Specialist reached out to investigator for an update. Licensing Specialist informed referral found unsubstantiated.

Staff advised officers that juvenile punched her in the stomach and attempted to bite her arm after staff asked juvenile to get off a staff chair. No injuries observed. Officers provided staff with incident number.

Staff advised officers that juvenile became irate because she was not given permission to make a phone call after hours. Juvenile grabbed staff member’s cellphone and ran to her room with it, then threw the phone. Cracks were observed on the screen. Officers provided staff with the incident number.

Battery, Battery Third Degree, Staff Attacked

Staff reported to officers that juvenile became irate because she could not finish a phone call, and the juvenile hit staff member on the side of the face with the telephone. A knot was observed on staff’s head. Staff also advised that the juvenile attempted to wrap the telephone cord around her (staff’s) neck, but staff intervened. Officers provided staff with the incident number.

Notice of Incident, Peer Sexual Contact

On 5/20/2023, client told a Centers’ nurse that one of her peers grabbed her hand and placed it on the peer’s “private part”. Client said she was in the classroom earlier in the day doing activities when client grabbed her hand and placed it on “private part”. Client said there was no conversation between the two prior to the actions. Both clients were fully clothed when the alleged incident occurred. Client reported that staff was present but did not see the alleged incident take place. This incident was reported to the Child Abuse Hotline and the reported allegation was accepted. Client was placed on sexual precautions due to this incident. Clients will not be allowed in the same dorm or classroom for the foreseeable future. Licensing Narrative: Licensing provided with documentation for sexual acting out precautions and line of sight protocol, informed no witness statements were taken and nurse’s note would be provided. 7/5/2023, Licensing Specialist informed case found unsubstantiated. Due to an existing condition client must have periodic lab work (blood draw) for a [REDACTED]. On 5/09/2023, [REDACTED] refused to allow Centers’ medical personnel to draw blood for the necessary testing. Centers’ staff transported to LabCorp, but [REDACTED] refused to allow medical personnel there to draw blood. Centers’ staff transported [REDACTED] to Arkansas Children’s Hospital (ACH) so medical personnel there could conduct a blood draw. Once at ACH, medical personnel were able to draw blood from [REDACTED] without further incident. After the blood draw at ACH, was transported back to EMAC. Licensing Narrative: 5/11/2023- Licensing reviewed the report for any licensing concerns.
